While nothing says that you can't let him have it personally one of two things may happen as a result. 1.) You may end up being banned from the store either simply by the store owner or legally if police etc. need to get involved. 2.) The "problem" may disappear into a back room and never be able to be seen again without a search warrant. Go ahead and nose around in the store, feel free to talk to employees as far as husbandry requirements but don't get confrontational with them the first time you go in. Make mental notes wihle you're in the store and write down as much as you can when you come out.
FIRST step is to get a copy of your state's animal cruelty RSA's. Read them top to bottom. Call the state vet/DOA whichever one controls licensing of shops. Be prepared to file a WRITTEN complaint and follow it through - all the way to court testimony if necessary. If you're not prepared to go that far then seriously think about what you want to accomplish. Once you've made THAT decision find out if you're state has any animal cruelty *investigators*. You can do this by possibly asking the state vet or calling around to any local mammal shelters. Find out who DOES handle cruelty complaints if no investigators are available.
Once you establish who handles complaints be prepared to fully educate them on exactly WHY you believe the shop is violating cruelty statutes. The majority of animalcontrol officers and animal cruelty investigators simply don't know what they're looking at when they see reptiles. Depending on the individual that you find you could wither have an easy time of convincing them or dang near impossible but there's only one way to find out.
