The "4 inch" rule stems from a 70's (?) decision by the Food and Drug Administration in an attempt to halt possible salmonella contamination. You can try giving the local FDA office a call. Local Animal Control maybe able to give you more insight as might your state veterinarian's office. Believe it or not, but be prepared to point out the FDA regulation to the state vet's office... Local Center for Disease Control (CDC) office might also want to know about this as well....

The fine for this infraction is, I believe, $1,000 per animal although I could be wrong. Personally, I'd make the calls. If the shop is knowingly selling undersized turtles - and I can't imagine that they do NOT know about the FDA reg. - what are the chances that they're also trafficing in other illegal animals ? Granted, it only takes one unscrupulous shop owner to give everyone a bad name but I've seen more than one shop doing just this.
