I would find out what type of three it is.
Ask your neighbors, who might have the same tree in their yard.
Or cut off a branch with leaves and berries and take it to a local nursery, they should be able to identify it.

Could be that the berries are fine and are a good food source for your tort.Then it would be a shame not to allow him to eat them.

But better safe than sorry, so I'd definately find out what type of tree it is.
What part of the country do you live in?

Also.
Can you describe the tree in more detail,or post a photo, size/shape of leaves.
Is it an evergreen?
Does it get flowers, if so what color are they?
How big are the berries?
