Present law contains several provisions governing the possession and sale of wildlife in this state. The Tennessee wildlife resources agency is responsible for the enforcement of those laws. It is unlawful for any person to possess, transport, import, export, buy, sell, barter, breed, or transfer any wildlife in this state without first obtaining a permit from the agency. Although the agency has enforcement power in regard to wildlife, the rules and regulations concerning such wildlife permits are promulgated by the Tennessee wildlife resources commission. This bill would transfer the enforcement and rulemaking powers in regard to the laws governing wildlife from the Tennessee wildlife resources agency and commission to the department of agriculture. This bill would not change the substance of those laws, except as necessary to reflect the change in the transfer of authority from the agency or commission to the department. NOTE: In Section 2 of this bill, under Section 44-21-105(h)(9), the word "permit" is missing at the end of the last sentence.
