I agree. Also, what told you T. s. annectens (aka Texas Garter) lives in NY? Garters are usually conspicuously marked at a young age, and have some pigment on the ventral surface. Again, I believe that a rough earth snake is very possibly the snake you have. You might also want to consider a flathead snake or a ground snake.
