Houseowners may not forbid to their tenants to have harmless snakes as domestic animals. That was the decision of the district court Bueckeburg (Az. 73 C 353/99), to whom the national building societies (LBS, Berlin) report. There is nothing is to be objected to by the snakes’ presence, if the appropiate use of the dwelling is not impaired and there is no danger from the animal. In this case a landlord had demanded that a tenant remove his 80 centimeters long Koenigsnatter (Kingsnake?) from the dwelling. Other inhabitants would have been offended by the snake. The court found that the innocuous animal does not represent a danger for the house inhabitants, and in addition its droppings were not a smell nuisance. The digusted feelings of the neighbours was not seen as a reason to forbid animal husbandry.

Hauseigentümer dürfen ihren Mietern nicht verbieten, ungefährliche Schlangen als Haustiere zu halten. Das geht aus einer Entscheidung des Amtsgerichts Bückeburg (Az. 73 C 353/99) hervor, über die die Landesbausparkassen (LBS, Berlin) berichten. Demnach ist gegen eine Schlangenhaltung nichts einzuwenden, wenn die sachgemäße Nutzung der Wohnung nicht beeinträchtigt ist und von dem Tier keine Gefahr ausgeht. In dem Fall hatte ein Vermieter verlangt, dass ein Mieter seine 80 Zentimeter lange Königsnatter aus der Wohnung entfernt. Andere Bewohner hätten sich vor der Schlange geekelt. Das Gericht befand, dass das ungiftige Tier keine Gefahr für die Hausbewohner darstelle, außerdem gehe von ihm auch keine Geruchsbelästigung aus. Ekelgefühle der Nachbarn seien kein Grund, eine Tierhaltung zu verbieten.
