I think in this case the fact that the entire building, INCLUDING this kid's apartment, was condemned is a fair indication although most certainly not the final clue. Somehow, I really don't think that animals - regardless of species - could be properly cared for in a building worthy of condemnation.
In any case, I think the judge either misinterpreted animal cruelty RSA's or the RSA's themselves are too weak to support serious offenders. Unfortunately, I haven't had time to dig through Kenton County's AC statutes.
