FINGER LAKES TIMES (Geneva, New York) 17 October 02 Woman sues Tops over 'lizard' incident (Kevin DeValk)
Canandaigua: A woman is suing a Geneva supermarket for $750,000 because she allegedly tripped over a reptile and injured herself while shopping there.
The accident allegedly happened three years ago at the Tops Friendly Markets on Routes 5&20 in Geneva, according to a lawsuit against Tops filed by Sandra O'Neil in state Supreme Court on Oct. 10.
O'Neil is alleging that while she shopped there on Oct. 19, 1999, a creature that appeared to be a lizard jumped out of a tropical plant display, and she tripped over the animal. As a result, she experienced extreme pain and suffering, and permanent injuries, resulting in loss of earnings and the need for hospital care, according to the summons.
The lawsuit does not tell how the creature got into the store, or what happened to it afterward.
Tops officials are declining to comment, said spokeswoman Stefanie Zakowicz.
O'Neil's attorney, Michael Roulan of Geneva, referred all questions to O'Neil, who could not be reached for comment.
