:A criminal charge of animal cruelty has been filed against a Little Torch Key man in the July shooting of an iguana, the Monroe County State Attorney's Office said Tuesday.

:John F. Marshall, 50, was issued a criminal summons for using a "pump pellet gun to shoot and kill an iguana which was in his back yard at the time."

:Two witnesses to the incident told the Monroe County Sheriff's Office they watched as Marshall shot the iguana at his Candice Avenue home in front of several house guests.

:"[One witness] stated he saw Mr. Marshall repeatedly fire the gun into the head of the iguana," said Deputy Manuel Cuervo.

:Another witness, who feeds the iguanas in the area, reportedly took a photograph of Marshall "picking up the iguana with a black garbage bag."

:Questioned at the time, Marshall allegedly admitted to the shooting, claiming to Cuervo "the iguana was trying to enter the residence."

:Returning 10 days later to gather witness statements, Marshall was said by a house sitter to be out of town on business; however, Cuervo reported he saw "numerous iguanas in and about Mr. Marshall's property."

:The witness also told Cuervo, "They like Mr. Marshall's yard because it has concrete. They like the warmth."

:Florida law suggests anyone convicted of an act resulting in the "cruel death or excessive or repeated infliction of unnecessary pain or suffering of an animal" could be sentenced to up to five years in jail and a $5,000 fine or "by a fine of not more than $10,000, or both."

:Calls to Marshall's home were not answered.

There is no way I could stand by and watch this happen. I'd stop the man then shoot a few pellets into his head to see how he liked it!
