Questions about a California Horned Lizard....?

Ok..heres the story:
My brother who lives in Cali. found a lizard where he works. He caught it, brought it home and called me to inform me that he was sending it to me. I told him to call some reptile stores and ask them how he should ship it
(i suggested maybe LLL reptile supply?? He lives sorta close by)
i have a general idea HOW to ship reptiles...because i used to recieve the lizards at a pet store i worked for, but i wanted him to get EXACT direction so that the lizard would get here alive.
He said it looks like my Bearded Dragons but smaller so i suggested "it might be a 'horny toad' or horned lizard". I'm guessing its like the lizards that iv'e seen pic's posted of on this forum.
Is it legal to keep them? (if not i'll be on the phone telling him to let it go!! :)

i have a few questions though...even if they turn out not to be legal to keep:

what do they eat? (i assume ants. any other bugs? any veggies?)
What kind of set up? (desert... anything similar to a beardie set up?)
How much humidity and temp can they stand and thrive best at?
ANY GENERAL ADVICE?
i dont have really any experience with these lizards...and they arent very common in the pet trade around here. i do own many other lizards though.
feel free to send me an email instead of a post...i'm not on the computer very often with college these days.
