How this kid is keeping a 5 foot gator IN the pond, if you know what I mean. Can't they climb fences? But I'd say there's a pretty decent chance the pond isn't large enough and I wonder if it's got a decent filtration system, and enough shade to keep the gator from broiling to death in July. And if it's illegal, it's illegal.
