Thanks for the pointer. There is a retention pond about 1/3 mile from our home so i will let it go there...

Sorry for the confusion. I forgot to add a few details (twice!)

I have found a picture that looks very similar called a blotched water snake ( http://www.ci.austin.tx.us/preserves/fotosnk12.htm ) from an Austin, TX website
