Like Dan said, DON'T release it to the wild. Although it is illegal in certain states to possess certain types of tortoises, you can easily get a permit from your local department of Fish and Game. You are not the one that took it, and just explain that to them. You can say you found it, someone left it at your house, it wandered into the yard, whatever. As long as you are not the one who took it, you shouldn't have any problems. If Fish and Game found out about your friend, however, that is a different story.
For example, in CA removing a CA Desert Tortoise from the desert can get you into quite a bit of trouble.
