You need to find a wooded area somewhere near where you found him. He has a burrow somewhere around there... even if it's in a bad place traffic wise. They do spread respiratory infections from area to area. The attempts to relocate populations "displaced" by construction have been a disaster.
Be aware that you can run over him with your car.... but you can't pick him up and carry him around legally. You might provide a home for him if there is absolutely nowhere to put him... it'd be illegal... but they are amazing torts... I used to keep a few "back in the day" before it became illegal.

: Live in Orlando, Fl. Found a gopher tortoise today walking along a busy road where I work. Not the first time I've picked one up, mind you. I brought it to a local park by my house and asked if I could release it there. The ranger responded that each 'colony' carries its own disease and didn't want me to release it in that park. Of course, I obliged, but now I'm wondering what would be best for my little buddy. I feel he faces a certain death should I release him where I found him. But, do tortoises, being territorial, fare well being relocated?
