You are right. Many states have grandfather clauses. A lot of time Fish and Wildlife don't know what to do with the animals. I get that a lot with box turtles in NY. All I do is request permission to send it out of state and give the reason (usually the animal has been in captivity too long to release or was injured and can't be released either). I just received permission to ship out a wood turtle from NY to a sanctuary in Ill. This was because the turtle could be proven unreleasable. I once arranged a gopher tortoise adoption from one state to another because Fish and Wildlife just didn't know what else to do with it. I actually wanted to ship it back to it's native state but the state refused to readmit it after it was illegally transported out (the tortoise was dropped on a door step of a museum several states away from it's native area). The receiving people had wildlife permits so none of the gov agencies minded me making the arrangements. At that point they were afraid it was going to end up on their desks if they didn't let me place it properly. As long as it is all done on the up and up they are pretty easy most of the time.

: As long as the animal is given to you or you can prove by grandfather clause there is no need what so ever. Straight from G&F themselves. We get alot of people in Las Vegas NV that send the extra torts to some homes in AZ because there are not enough homes int he Vegas area and they will not release any collected animals into the wold do to high chances of resp infections which are detrimental to desert torts.
