I wouldn't do a thing if I wasn't 100% absolutely sure that it was a gopher tortoise.

Then even after I found out it was, I probably wouldn't do anything either because their welfare in my eyes is more important. If private collectors have them they may stand the chance to not become extinct in the next 25 years or so, so I would look away.

That is just my opinion, but again I would make sure they were what you think they are before you sick the USFWS on the unsuspecting petstore who bought them from someone telling them they were SAND TURTLES (or whatever).
