I am not sure if their natural range extends that far North. It might be an escaped pet.
If you live in a state where they are native, you must register them with your department of Fish and Game or Department of Natural Resources.
I will see if I can find any info and will post again.
I keep California Desert Tortoises, do you need care info?
If it cannot burrow and hiberate without freezing or if you are in an area of heavy snow, I don't think it should be housed outdoors for the winter. It gets very cold in our deserts, however the tortoises are in deep burrows protected from the elements.
Anyhow, I'd keep it awake and up and inside for now.
