-The availability of water should not even be an argument. Not providing it is strictly a matter of the keepers convience. I can see no harm in in making fresh water available at all times.
-A rest period is suspected to be beneficial and in most cases is provided incindentally by way of the change of the seasons but there does not seem to be any evidence that it is a requirement for a tortoises well being.
