You can't hibernate a tortoise that has food in it's gut. Plus you shouldn't hibernate a tortoise the first year you have it. Or unless it's absolutely 100% healthy.
Have you ever taken this tortoise to a vet?
Had it examined and tested for internal parasites, (worms)?
I really sugest you take the tortoise to a qualified reptile vet ASAP.It sounds as though it's already very sick, or is getting very sick, very quickly.
It needs to be seen by a vet.
Please take it to a vet and let us know what he/she says, make sure the vet also tests for worms. But don't try to treat it yourself, have the vet give Gary the medication.
Also make sure that it's housed correctly, in a large enough enclosure with the correct temperatures.
What substrate are you using?
Some substrates are toxic, let us know what you're using.
But please get Gary to a vet ASAP.
