They aren't that hard to find... I have seen a few, and dont think that there are any regs against taking them in particular, I think I will probably find a couple in spring when I go with my friend upstate..... (CA that is...) If this is the same subspecies you mention..... feel free to email me... don't have my field notes w/ me, so I can't quote stuff 2 you right offhand.
